Shein Faces EU Scrutiny Over Potentially Harmful Products and Design Features

Brussels: EU regulators have launched an investigation into Shein, suspecting that the company has not adequately prevented the sale of illegal products and has failed to protect consumers from allegedly addictive design features on its platform. According to Deutsche Welle, the European Commission announced on Tuesday that it had initiated formal proceedings against Shein under the Digital Services Act (DSA). This investigation will scrutinize the Chinese-founded discount fashion retailer, primarily operating online, for its "addictive design, the lack of transparency of recommender systems, as well as the sale of illegal products, including child sexual abuse material." Should Shein fail to comply with EU regulations, it may be required to modify its practices or face significant fines. The Commission emphasized that the investigation is still in its preliminary stages, and no conclusions have been drawn regarding any potential misconduct by Shein. The duration of the investigation remains uncertain as t he Commission conducts an in-depth examination of the retailer's practices. The investigation will focus on several critical areas. Chief among these is Shein's ability to prevent the sale of illegal products within the European Union, particularly content that could be classified as child sexual abuse material, such as child-like sex dolls. Additionally, the investigation will address concerns over the "addictive design of the service," which includes rewarding users for engagement and evaluating the systems Shein has implemented to mitigate associated risks. The transparency of Shein's recommender systems, which suggest content and products to users, will also be scrutinized. The controversy surrounding the sale of sex dolls resembling children surfaced in November, coinciding with the opening of a new Shein physical store in Paris. The ensuing protests prompted the French government to call for an EU investigation into potential misconduct. Moreover, Shein faced backlash over the availability of illegal weapons, such as firearms, knives, and machetes, on its platform. While the French government attempted to block access to Shein's site in France, a court intervened, requesting the Commission to initiate a DSA investigation instead. The Commission also expressed concerns that the allegedly addictive design features could negatively impact users' well-being and consumer protection online. Under the DSA, Shein is expected to disclose the primary parameters used by its recommender systems and offer users at least one easily accessible option that does not rely on profiling for each system. Shein's European base is located in Ireland, known for its favorable tax conditions, a common choice for tech companies requiring minimal physical presence. The Coimisiún na Meán, the Digital Services Coordinator for Ireland, will also be involved in the investigation. With Shein's global turnover for 2024 estimated at approximately $38 billion, the company has rapidly expanded internationally since relocating its global he adquarters from China to Singapore for regulatory and financial advantages.
